 Aren’t events unfolding give rise to fear that Pakistan has lost chance of ever having an impartial judiciary? [Issue Date: Wednesday, May 27, 2009]
    
 8 Pakistan was founded by Quaid- e- Azam for true and sincere Pakistanis, but the greedy selfish and corrupt politicians made it hell for the poor and miserable Pakistanis. Whenever any leader came to rule in Pakistan, the first priority he gave was to get loan from foreign countries in the name of this miserable nation. Instead of investing on some good projects, they put this loan in their private accounts in foreign countries. The drama being played by the rulers from the last 62 years and still going on with its full swing. In this play the prominent characters are bureaucrats, generals, maulvis, bloodsucker politicians. As long as our beloved country is under debt, we will obey the orders of those countries, who have given us loans and their agents are sitting in our ministries, they will issue orders. In such a critical situation how our judiciary can be impartial. These donor countries are so powerful that they will also not like that our judiciary should be impartial. We were having very much expectation, but these super powers know our weakness, so they very easily bought our rulers and then these rulers interfere in judiciary. It is also a fact that there are many black sheep in our judiciary and it will not be impartial. The only solution for our survival is to get rid of debt and hang all the corrupt bloodsucker politicians.

 8 The only way to make judiciary impartial is to follow the American way. A supreme judge goes through a rough interview by the judiciary committee. After the committee approves an appointed judge will protect the constitution and the law of land. Then, he is accepted as a Supreme Court judge for life. Nobody has power to remove him except impeachment and nobody can block the payment of his wages.

 8 The judiciary for covert reasons has always supported Nawaz Sharif whether it is a matter of his dissolved government, or he is guilty of attacking the Supreme Court and sacking a CJ, or he is guilty of hijacking a plane of our COAS. If he was innocent he should have stayed in Pakistan and faced jails like the leaders of PPP did instead of running away like a coward to Saudi Arabia and that also by signing a deal about which he kept on lying to his public. People make a fuss about NRO because Zardari is its beneficiary, but yet forget that this Zardari faced jail for more than 12 years with nothing proven against him. But the whole world witnessed Nawaz's hijacking of a plane and the same people hail the decision of judiciary to let Nawaz participate in elections. What double standards!

 8 Let us face the fact that we are a corrupt society. Where are you going to find an honest judge or politician? So one should aim at less corrupt and a capable person. And there are not many around!

 8 We are embroiled in a situation engineered by covert hands to make us a ‘failed State’ and change geography of the whole region planned under a huge international conspiracy. The recent events in Swat have created a horrible tsunami of suicide-bombings, which clearly is a weapon of mass destruction being employed by the hidden hands with complete impunity. Our brain-drained bureaucracy and self-serving clout of politicians have been custom made to hasten our downfall. Unseen strong hands are pushing us back on a fast track to failure. The lawless lawyers using long march as a tool to put reins on the judiciary criminalization or de-legitimization of the State.

The born again politicians and the reincarnated judiciary are inter-twined in mutual favour returning gala, pulling their fastest ones against the people who gave them their new lease of life. Resulting events show deterioration of public services in every segment of its responsibilities. It is lost in direction security apparatus is deliberately being made to work against its own people. Rise with vengeance of the factionalized elites against the hapless people they ride the shoulders on for their rise, are back again for god knows how many more donkey years and are sharpening axes for fighting their wars of divisional scavenging.

To add salt to injuries, there are ever rising demographic pressures, chronic apathy of the government towards fast economic distress, indifference to the huge humanitarian conditions generated by the misguided and ill conceived initiatives against miscreants, etc. These are clearly the basic ingredients that ideally create a ‘failed state’ and nobody appears to understand it. For making the journey to the doom more secure and certain, heavy infusion of IMF, World Bank and other monsters’ soul sapping interventions are being employed. But, our judiciary intoxicated by its new-found reincarnation, is over burgeoned in reciprocating favours to its so-called saviours to the extent that it has become completely blind to the real tasks of providing justice to the masses and securing their rights to live. The existing state of the judicial system is aggravating our perpetual degeneration as a nation. Situation is hopeless to the extent that now only a divine intervention can rescue us out of it.

 8 Restoring the birthright of Sharif brothers -- to contest election -- taken illegally by an illegal usurper dictator -- is not a favor -- returned by Iftikhar SC to Sharifs for the CJ's own restoration. It is injustice undone -- it is justice wrongly delayed -- finally rightly done -- by an impartial Supreme Court -- against the made up false charges -- perpetuated for so long -- against the two legitimate heads of the two illegitimately overthrown provincial and federal governments -- by an illegitimate dictator installed -- and a wannabe stalled - Dogar Court.

 8 There is no conception of impartial or independent judiciary anywhere in the world. Even in U.S.A. where it is said that the judicial system has reached to its maturity and important judicial decisions on any subject passed by the Supreme Court are being cited in different judicial courts of the world as a precedence, but even there we can observe that the judges are divided in different groups, some are liberal, some are conservative, some are pro-abortion and some are anti-abortion, some are pro-gay marriage and some are anti-gay marriage. The Democratic president appoints the judges of his choice and Republican president appoints of his choice. But we can say that there is no outside interference or any political interference except this.

So far the judiciary in Pakistan is concerned, the worst type of interference was seen at the time of General Musharraf's presidency, when the General sacked the Chief Justice of Supreme Court and many judges of Supreme Court and High Court were sacked and new judges were appointed. The courageous stand taken by the members of the Bar Associations to restore the independence of judiciary in Pakistan and to reinstate the deposed Chief Justice Mr. Iftekhar Choudhry was a landmark move, which can be said to be a great achievement for the whole judiciary.

The question is not only that how far the judiciary in Pakistan is impartial, none committed or independent, but this is also a matter of concern that the door of judiciary is accessible to all without any distinction of rich and poor for speedy justice. The system of justice based on Anglo-Saxon principles is not perfect and without any fault. The time taking and lengthy procedures of trial and then to file appeals against the judgment passed in the trial court makes it very costly and time consuming, then the aggrieved party may move to the High Court and Supreme court against the judgment passed in Appellate Court, makes it further lengthy and delayed, which supports the notion of saying "The justice delayed is the justice denied."

This type of justice system is not suitable, in my opinion for the poor people, that is why the Shariat Court in Swat was more popular because of speedy justice and its availability for all poor or rich alike.

 8 Every conscientious-minded Pakistani can see the role of restored judiciary by noting how Justice Ramday, challenged the extension given to Shoab Suddle as D.G. IB, probing into cases of missing persons and lately into rationale of inflated prices of petroleum products. The unfair deal with Balochistan, NWFP or even Sindh is not with the connivance of the present judiciary, but outcome of vested interest of rulers.

 8 Taking the past and present in view it is very obvious and crystal clear that Pakistan never had or will never have impartial judiciary. Our news media does not care they are just keeping their job. Even our views are not printed as they should be, cause editors are scared for their-self too, corrupt government i.e. Mr. 10% will destroy them.

 8 The present decision of judiciary can be observed carefully. There are many angels to see this decision. The two judges on both the benches gave 100 % opposite of their own past decision in writing on the record. These are not my comments, but facts on record. In some people point of view, it was a give and take. One restored with power politics. Other rewarded in return by U-turn decision. But I personally cannot comment because nobody can comment on judiciary. No doubt our judiciary is free. So it is also free to take U-turn. Everybody appreciating the quick decision, but it may be due to elite class case otherwise many cases including my own recovery case is pending in Balochistan High court from last seven years because I am a common man, third class citizen of Pakistan.

There are many aspects of this decision. Media is also free like our judiciary. I like to invite a writer of any elite class to please write on this because I am afraid to comment on this, my own case is in Balochistan High Court pending from seven years, if I write any thing, it will take more 100 years to recover my own amount.
